Ownership / Rights: Who will hold the copyright to the program?

ITVS will hold the exclusive distribution license to the finished project (and all its elements) in all markets, worldwide. Copyright will be retained by the filmmaker. Additional details of the contract will be made available to all of the finalists.

I am co-writing with an individual whose life story our project will be based on. We will base our material on some of her published poetry and use some of her poems in the piece. If we can secure the rights within our budget, is ITVS okay with that?

Let me clarify my previous post. After talking with the author on whose life story this project will be based on, it turn out the published material is in journals rather than books. Look forward to receiving your comments.

In response to Ben: if your proposed project is based on an underlying work by another author, and all necessary rights clearances will be acquired within the budgetary constraints of development funds, that is acceptable to ITVS. Also, if the project is greenlit for development, ITVS will take holdback rights to any additional adaptations of the underlying work during the term of the license period. Thus, these adaptations will be subject to ITVS approval during the license period and will be considered on a case-by-case basis.
